Welcome to GrowthPath. By creating an account or using our service, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use GrowthPath.

GrowthPath is operated by GrowthPath ("we," "us," or "our"). These terms govern your access to and use of our website, web application, and related services (collectively, the "Service").

1. Eligibility

You must be at least 18 years old to create an account and use GrowthPath. By registering, you confirm that you are 18 or older and have the legal authority to enter into this agreement. GrowthPath is intended for use by parents and guardians — not directly by children.

2. Your Account

• You are responsible for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• You must notify us immediately if you suspect unauthorised access to your account.
• You may not share your account with others or create multiple accounts to circumvent subscription limits.

3. Accuracy of Child Data

You are responsible for the accuracy of any child information you enter into GrowthPath, including names, ages, and milestone progress. We use this data solely to provide the service to you. Please keep your children's profiles up to date.

You must have parental or guardian authority over any child whose data you enter. Do not enter data for a child who is not in your care.

4. Subscription & Billing

GrowthPath offers the following subscription plans:

• Monthly: $4.99 per month, billed monthly.
• Annual: $39.99 per year, billed annually (save ~33%).

Subscriptions renew automatically at the end of each billing period unless you cancel beforehand. You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will retain access until then.

No refunds are issued for unused portions of a billing period, except where required by law. All prices are in US dollars. Payments are processed securely by Stripe.

We reserve the right to change subscription pricing with at least 30 days' advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.

5. Free Tier

GrowthPath offers a free plan with access to a limited set of features. Free plan availability and feature limits may change at any time with reasonable notice.

6. Acceptable Use

You agree not to:

• Use GrowthPath for any unlawful purpose or in violation of any regulations.
• Attempt to reverse-engineer, hack, or circumvent any security measures.
• Upload or transmit harmful, malicious, or offensive content.
• Scrape, harvest, or systematically extract data from the Service.
• Use the Service on behalf of others without their consent.
• Interfere with the operation of the Service or its infrastructure.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Intellectual Property

All content, features, and technology within GrowthPath — including our skill framework, milestone library, design system, and software — are owned by GrowthPath and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

You retain ownership of the data you enter (child profiles, progress records). By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.

8. Privacy

Your use of GrowthPath is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your data.

9. Disclaimers

GrowthPath is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or that any particular outcome will result from using it.

GrowthPath is an educational tracking tool. The milestone framework and skill paths are not a substitute for professional medical, psychological, or educational advice. Always consult qualified professionals for concerns about your child's development.

10. Limitation of Liability

To the fullest extent permitted by applicable law, GrowthPath and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or emotional distress — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless GrowthPath from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

12. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
